This guarantee applies solely to engagements where the client follows the recommendation provided by Harry Lakin and The Decision Room™. Engagements where the client selects a candidate other than the recommended finalist are expressly excluded from this guarantee. No cash refund will be provided under any circumstances. The guarantee provides for one repeat engagement only, subject to Harry Lakin's availability, and applies to the same role for which the original engagement was conducted.
The guarantee is void and no repeat engagement will be provided in the following circumstances:
- (1)The position is eliminated, restructured, or materially changed following the hire.
- (2)The company undergoes acquisition, merger, or significant change in ownership.
- (3)The candidate voluntarily resigns for personal reasons unrelated to job performance or fit.
- (4)The candidate accepts an unsolicited outside offer or is recruited away.
- (5)The candidate experiences a personal health, family, or relocation circumstance unrelated to the role.
- (6)The client materially misrepresented the role requirements, compensation, reporting structure, or company circumstances during the engagement.
- (7)The company undergoes significant layoffs, downsizing, or restructuring unrelated to the performance of the hired candidate.
- (8)The company ceases operations or files for bankruptcy protection.
- (9)Circumstances arise from events beyond the reasonable control of either party including but not limited to natural disasters, pandemics, or significant economic disruption.
- (10)Death of the candidate.
The Decision Room™ is an independent advisory service. Harry Lakin and Hire Capacity assume no liability for hiring outcomes beyond the terms described herein. This guarantee represents the sole and exclusive remedy available to the client in connection with The Decision Room™ engagement.
